1. Membership Eligibility: Burn & Breathe (Fitness & Nutrition Hub) constitutes a private establishment, and access to its premises and amenities is restricted exclusively to registered members and their duly authorized guests.
2. Payment Terms: All membership dues are to be settled in advance, prior to the commencement or renewal of membership rights and privileges.
3. Renewal Obligations: Members are mandated to effectuate renewal of their membership no later than seven (7) days prior to the expiration of the current term to avoid any suspension or disruption of services.
4. Transfer of Membership: Membership privileges may be transferred, subject to a non-refundable transfer fee of ₹2,500, plus applicable statutory taxes.
5. Biometric Access Control: Each member shall be assigned a unique biometric identifier for the purposes of secure access to the club’s facilities. Members are required to ensure that their biometric data is duly enrolled in the club’s system. Any issues with biometric access should be immediately reported to the front desk for remedial action.
6. Guest Accountability: Members shall assume full legal and financial responsibility for the actions, conduct, and behavior of any guests they sponsor or admit onto the premises.
7. Prohibited Articles: The consumption of tobacco, alcoholic substances, and the possession or use of any form of weaponry are strictly prohibited within the confines of the club’s premises.
8. Unaccompanied Individuals: Access to the club premises is restricted to registered members and their accompanied guests only. Unaccompanied minors, attendants, drivers, or other non-registered individuals are prohibited from entering the premises.
9. Managerial Authority: The management reserves the absolute discretion to refuse access or expel any individual whose conduct is deemed disruptive, harmful, or incompatible with the club’s established norms and decorum.
10. Finality of Managerial Determinations: Any decision rendered by the club’s management with respect to the enforcement of these terms and conditions, or regarding any violations thereof, shall be final, binding, and unappealable.
11. Force Majeure: The club shall not be liable for any failure to perform or delays in performance due to events or circumstances beyond its reasonable control, including but not limited to acts of God, government intervention, public health emergencies (such as pandemics), or any other unforeseen event. In such cases, no refunds or membership extensions shall be granted.
12. Modification of Club Operations: The club reserves the right to amend its operational hours, services, or availability of facilities without prior notice, based on operational exigencies or unforeseen circumstances.
13. Hours of Operation: The club shall remain operational seven (7) days a week, with hours of operation determined at the sole discretion of the management.
14. Pets and Animals: The presence of animals, including pets, within the premises of the club is expressly prohibited.
15. Rate Modifications: The club retains the unilateral right to adjust membership fees, guest charges, or any other related fees as deemed necessary, in its sole discretion.
16. Amendment of Policies: The club reserves the right to modify, amend, or introduce new policies, rules, and regulations, which shall be immediately binding upon all current and future members, as well as their guests, upon notice.
17. Waiver of Liability: The club shall not be held liable for any injury, loss, or damage, whether physical, mental, or otherwise, sustained by any member or guest in connection with the use of the club’s facilities, equipment, or services, under any circumstances.
18. Communication and Consent: By becoming a member, individuals consent to the receipt of electronic notifications, including but not limited to updates, alerts, and communications related to the club’s operations, events, and member services.
19. Membership Suspension: Members holding half-yearly or yearly memberships may elect to suspend their membership for a maximum of thirty (30) days, subject to a freezing fee of ₹999 plus applicable taxes. Such suspensions are limited to a single occurrence during the term of the membership.
20. Personal Property and Liability: The club assumes no responsibility for any loss, theft, or damage to  personal property, including valuables, brought onto the premises by members or guests. Members are solely responsible for safeguarding their personal belongings.
